This case was called from the calendar of the Court's San Antonio, Texas trial session, conducted remotely on September 27, 2021. There was no appearance by or on behalf of petitioner Jerry L. Roach. Petitioner Brenda Roach, and counsel for respondent appeared and were heard.
This case was recalled the same afternoon. At recall, respondent's counsel made an oral Motion to Dismiss for Lack of Prosecution as to Jerry L. Roach. This case was recalled again on September 28, 2021. Again, there was no appearance by Jerry L. Roach. Petitioner Brenda Roach appeared and made an oral Motion for Continuance. Counsel for respondent appeared and did not object to the motion. Upon due consideration, and for cause more fully appearing in the transcript of the proceeding, it is
ORDERED that respondent's oral Motion to Dismiss for Lack of Prosecution as to Jerry L. Roach is taken under advisement. It is further
ORDERED that the undersigned retains jurisdiction of this case. It is further
ORDERED that Jerry L. Roach shall, on or before October 28, 2021, show cause in writing why respondent's motion should not be granted. Mr. Roach is advised that failure to comply with the terms of this Order may result in the Court granting respondent's motion and entering an order and decision against him. It is further
ORDERED that Brenda Roach's oral Motion for Continuance is granted and this case is continued pending further direction of the Court. It is further
ORDERED that the parties shall, on or before January 26, 2022, file a joint status report regarding the then-present status of this case.
