These cases were on the Court's June 12, 2023 trial calendar for Buffalo, New York. They arise from respondent's challenge to a microcaptive-insurance arrangement. There had been some delay because respondent's lead counsel withdrew, and new counsel had to catch up.
The parties recently reported that they have met and continue to work on informal discovery issues and continue discussions on possible settlement. They are confident that with more time they can resolve these cases without the need for trial or reduce the issues to be tried.
It is therefore
ORDERED that on or before July 11, 2024 the parties file a joint status report describing any progress in settling these cases or completing informal discovery, as well as their respective estimates of whether a trial will be necessary.
