The Court, having reviewed the Report and Recommendation of Judge Theresa L. Fricke, United States Magistrate Judge, objections to the report and recommendation, if any, and the remaining record, does hereby find and ORDER:
(1) The Court adopts the Report and Recommendation;
(2) Defendants' second motion for summary judgment (Dkt. 162) is GRANTED in part and DENIED in part;
(3) Defendants' motion is DENIED with respect to plaintiff's claims against defendant Edwards and defendant Kroha for failure to treat his pain;
(4) Defendants' motion is GRANTED with respect to all other claims and defendants. All claims against defendants Edwards and Kroha except claims for failure to treat plaintiff's pain, and all claims against all remaining defendants, are DISMISSED with prejudice.
(5) Plaintiff may maintain his in forma pauperis status in the event of an appeal.
