ORDER

This case is on the calendar of the Court's April 15, 2024, trial session in Cleveland, Ohio. Respondent filed a Status Report on April 10, 2024. According to the report, respondent conceded its position. Respondent sent petitioner a decision on April 5, 2024, stating there is no deficiency or penalty owed from, and no overpayment owed to, petitioner for tax year 2021. Respondent has not yet received a signed decision from petitioner but hopes it will arrive before April 15, 2024. Respondent requested that the Court retain jurisdiction of this case and order a decision to be filed by May 15, 2024.

Upon due consideration, it is

ORDERED that this case is stricken from the above-referenced trial session, and the parties are excused from appearing at the calendar call on April 15, 2024. It is further

ORDERED that, on or before May 15, 2024, the parties shall file a proposed stipulated decision. It is further

ORDERED that jurisdiction of this case is retained by the undersigned.
