On October 7, 2024, respondent filed with the Court a Motion to Dismiss for Lack of Prosecution. This case was called from the Calendar of the Court's Fresno, California trial session on October 28, 2024. There was no appearance by or on behalf of petitioner. Counsel for respondent appeared and was heard. Upon due consideration and for cause more fully appearing in the transcription of the proceedings, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution filed on October 7, 2024, is taken under advisement. It is further

ORDERED that jurisdiction is retained by the undersigned. It is further

ORDERED that, on or before December 12, 2024, the parties shall submit to the Court a Proposed Stipulated Decision or file a joint status report detailing the then-current status of the case.
