Opinion
Gen. No. 41,338. (Abstract of Decision.)
Opinion filed April 15, 1941. Rehearing denied May 5, 1941.
MASTERS AND COMMISSIONERS, § 9 — fees, entering order for after expiration of term. In injunction proceedings where plaintiff had stipulated to pay master's costs, original decree submitted contained provision for such payment by plaintiff, but when chancellor asked for short decree omitting findings of fact master's fees were inadvertently omitted, court had jurisdiction after expiration of term to tax master's fees as costs against plaintiff, as decree confirming master's report approved recommendations as to fees and costs.
