Benjamin Ritchie, Appellant, v. State of Indiana, Appellee.

Trial Court Case No. 49G04-0010-CF-1729

ORDER

Mark S. Massa Justice, Indiana Supreme Court

This case is before the Court on the State of Indiana's "Verified Motion to Set Execution Date." Ritchie, by counsel, has filed a motion seeking my recusal from 24S-SD-342. The basis for Ritchie's request is that while serving as a Deputy Prosecuting Attorney in Marion County, I participated in his pretrial and trial proceedings. On October 3, 2024, this Court issued an order setting a briefing schedule and noting my non-participation in this matter.

Because I have already recused from this case, Ritchie's "Verified Motion for Recusal" from case number 24S-SD-342 is DENIED as moot.
