Rissy v. Hayns

Court of King's Bench Latch's Reports
Jan 1, 1793
1 N.C. 758 (N.C. 1793)

Opinion

(1793.)

Case on several assumpsits of nine particular sums, qua quidem separales summae attingunt at £ 52, which was more than the total sum really was. On a plea of the general issue, there was a verdict for the plaintiff. And

Andrews moved in arrest of judgment, this matter ut supra and also quod saepius requisitus non solvit the £ 52. Nota that the jury only found £ 40 damage; which was less than the aggregate sum; and cited 5 E., 3, 14.

It was a surplusage to cast up the particular sums. But if the request had been necessary, the declaration would have been bad.
