Juan RIPPSTEIN, Appellant v. The STATE of Texas, Appellee

From the 187th Judicial District Court, Bexar County, Texas
Trial Court No. 2015CR9366W
Honorable Steve Hilbig, Judge Presiding

ORDER

The trial court imposed sentence on May 2, 2017, and appellant did not file a motion for new trial. Because appellant did not file a timely motion for new trial, the deadline for filing a notice of appeal was June 1, 2017. See TEX. R. APP. P. 26.2(a)(1). A notice of appeal was not filed until June 19, 2017 — we construe appellant's request for appointment of appellate counsel as a notice of appeal. Appellant did not timely file in this court a motion for extension of time to file the notice of appeal. See id. R. 26.3. Thus, his motion for extension of time to file his notice of appeal is DENIED as untimely.

We therefore order appellant to show cause in writing why this appeal should not be dismissed for lack of jurisdiction. Appellant's response to this order must be filed with this court no later than July 29, 2017. All appellate deadlines are suspended until further order of the court.

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 29th day of June, 2017.
