The reporter's record in this appeal is overdue. By postcard dated August 30, 2024, we notified Robin Washington, Official Court Reporter for County Court at Law No 2, that the reporter's record was overdue and directed her to file the reporter's record within thirty days. On September 27, 2024 Ms. Washington informed the Court the record had not been filed because of her "heavy work load" and "waiting on payment." Ms. Washington requested a twenty-day extension to file the record. By letter October 1, 2024, we informed appellant regarding the lack of payment for the reporter's record and requested verification showing he had requested preparation of the reporter's record and paid or made arrangements to pay for the record. On October 10, 2024, appellant provided documentation showing the record had been requested and payment had been made.
To date, the reporter's record has not been filed and Ms. Washington has not further corresponded with the Court regarding the reporter's record. So that this appeal can proceed, we ORDER Robin Washington to file the reporter's record within TEN DAYS of the date of this order. We CAUTION Ms. Washington that failure to do so may result in an order that she not sit as a court reporter and for the trial court to conduct a hearing to determine the status of the reporter's record.
