This cause is currently before the Court on appellant's motion for extension of time to file the brief. Appellant's brief was originally due September 28, 2015. On December 2, 2015, this Court abated and remanded this matter to the trial court because counsel for appellant filed a motion to withdraw. A supplemental record containing the trial court's appointment of new counsel was filed on January 4, 2016. We reinstated the case and notified counsel the brief was due on February 3, 2016. Counsel is now requesting an extension of 120 days to file the appellate brief in this cause.
The Court, having fully examined and considered appellant's motion for extension of time to file the brief, is of the opinion that, in the interest of justice, appellant's motion for extension of time to file the brief should be granted with order.
The Court GRANTS IN PART and DENIES IN PART appellant's motion for extension of time. This motion is GRANTED insofar as the Court will extend appellant's deadline to file his brief until April 6, 2016. This motion is DENIED insofar as the Court will not allow an extension until May 3, 2016. Further motions for extension of time will not be favorably entertained by this Court, absent exigent circumstances.
