Steven M. Riley & Cheryl J. Riley Petitioners v. Commissioner of Internal Revenue Respondent

ORDER OF DISMISSAL

Emin Toro, Judge

This case is currently set for trial during the Court's November 15, 2021, Dallas, Texas, remote trial session. On September 24, 2021, petitioners filed an unopposed Motion for Continuance of Trial (Doc. 6). The motion bears an incorrect docket number.

On September 29, 2021, the parties filed a Joint Motion to Close on the Ground of Duplication (Doc. 7). In the motion, the parties advise that the petition filed in this matter is a duplicate of the petition filed at Docket No. 8791-20. The Court's review of both matters indicates that the parties' motion is accurate, and the Court will dismiss the case on the ground of duplication. Upon due consideration, it is hereby

ORDERED that petitioners' Motion for Continuance of Trial filed September 24, 2021, is stricken from the record in this case. It is further

ORDERED that the parties' Joint Motion to Close on the Ground of Duplication filed September 29, 2021, is granted, and this case is dismissed on the ground of duplication with Docket No. 8791-20.
