May 3, 1996
686 So. 2d 12 (Fla. Dist. Ct. App. 1996)

Opinion

No. 94-03446.

May 3, 1996.

Appeal from the Circuit Court for Hillsborough County; Susan Sexton, Judge, and William Fuente, Acting Circuit Judge.

James Marion Moorman, Public Defender, and John T. Kilcrease, Jr., Assistant Public Defender, Bartow, for Appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Ronald Napolitano, Assistant Attorney General, Tampa, for Appellee.

Counsel for appellant filed a brief pursuant to Anders v. California, 386 U.S. 738, 87 S.Ct. 1396, 18 L.Ed.2d 493 (1967), which raised two possible issues. We affirm the denial of the motion to suppress but strike a $50.00 assessment to the Hillsborough County Court Improvement Fund. Reyes v. State, 655 So.2d 111 (Fla. 2d DCA 1995) (en banc).

Affirmed, cost stricken.

CAMPBELL, A.C.J., and PATTERSON and QUINCE, JJ., concur.
