Stephanie Ann Richardson v. The State of Texas

Criminal District Court 1 of Tarrant County, Trial court case number: 1612397

ORDER

RICHARD HIGHTOWER, JUDGE.

Stephanie Ann Richardson is represented by appointed counsel Daniel Collins. On December 11, 2023, appellant filed a pro se motion for bond. On December 14, 2023, appellant filed a pro se motion to reduce sentence. On February 1, 2024, appellant filed a pro se motion to appoint different counsel and for appellant to be appointed as co-counsel.

A criminal defendant is not entitled to hybrid representation, meaning that an appellant who is represented by counsel is not entitled to file motions and briefs in the appellate court. See Sheehan v. State, 201 S.W.3d 820, 823 n.2 (Tex. App.-Waco 2006, no pet.); In re Adams, No. 01-12-00021-CR, 2012 WL 589035, at *1 (Tex. App.-Houston [1st Dist] Feb. 23, 2012, no pet.). Moreover, the motion to appoint different counsel asserts that appointed counsel has failed to file a brief. The brief was filed on January 18, 2024.

Accordingly, because appellant is represented by appointed counsel, the pro se motion for bond, motion to reduce sentence, and motion to appoint different counsel are denied.

It is so ORDERED.
