ORDER ON APPLICATION
Application by the respondent-appellant pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief on an appeal from a judgment of the Supreme Court, Suffolk County, dated June 13, 2012.
Upon the papers filed in support of the application and the papers filed in opposition thereto, it is
ORDERED that the application is granted and the respondent-appellant's time to serve and file an answering brief, including his points of argument on the cross appeal (see 22 NYCRR 670.8[c][3]), is enlarged until June 3, 2013, and the respondent-appellant's brief shall be served and filed on or before that date.
