Civil No. 99-7-B (D. Me. Oct. 27, 1999)

Opinion

Civil No. 99-7-B.

October 27, 1999.

ORDER

Hearings on motions in limine to exclude various witnesses were held on October 18, 1999. The Court ruled on these motions as follows:

(1) The Court DENIED Defendant's Motion to Exclude Plaintiffs' Expert, Gerald M. Palmer. The Court further ordered that Plaintiffs may not, on the current record, put into evidence facts of subsequent remedial measures. See Fed.R.Evid. 407.
(2) The Court DENIED Plaintiffs' Motion to Exclude Defendant's Expert, Dennis Skogen.
(3) The Court DENIED Defendant's Motion to Exclude Plaintiffs' Vocational Rehabilitation Expert, Sylvia Bailey. The Court ordered Plaintiffs to provide Defendant with a copy of Ms. Bailey's complete medical report on Dwayn Rich within twenty days, and to provide Defendant with an opportunity, at Plaintiffs' expense, to depose Ms. Bailey. The Court also ordered that the parties mutually arrange for this deposition at Defendant's convenience.
(4) The Court DENIED Plaintiffs' Motion to Exclude Finnish Witnesses. The Court ordered Defendant to provide Plaintiffs with a complete answer to Plaintiffs' interrogatories with regard to these witnesses within twenty days. The Court further ordered that Plaintiffs be given an opportunity to question these witnesses at this courthouse just before trial.

The Court will not revisit its prior order denying the Defendant's Motion for Summary Judgment, and therefore Defendant's Motion to Strike and Exclude the Supplemental Opinions of Plaintiffs' Experts is DENIED.

SO ORDERED.
