This case was set for trial at the New York, New York, trial session of the Court beginning March 28, 2022. When this case was called from the calendar on March 28, 2022, there was no appearance by or on behalf of petitioner, Vince James Ricci; but the Commissioner appeared through counsel and informed the Court that the parties were close to reaching a basis of settlement in this case. The Commissioner also filed with the Court a motion to dismiss for failure to properly prosecute this case, but stated the expectation that the parties will file a propose stipulated decision, which would render the motion moot. For cause more fully appearing in the transcript of the proceeding, it is

ORDERED that the judge signing this order retains jurisdiction. It is further

ORDERED that Petitioner shall file a response to the motion to dismiss no later than April 27, 2022, unless the parties have filed a Proposed Stipulated Decision.
