PER CURIAM.

Pursuant to Appellee's Concession of Error, the circuit court's October 30, 2012 Final Judgment for Plaintiff is reversed and this cause is remanded to the circuit court for further proceedings.

REVERSED and REMANDED. PALMER, LAWSON and BERGER, JJ., concur.
