Pro Se Motion for Extension of Time to File Appellant's Brief [Circuit Court of Little River County, CR 92-84, CR 92-85, Hon. Charles A. Yeargan, Judge], Motion Granted.


In 2008, appellant George Lemoin Rhoades filed in Little River County Circuit Court a pro se petition that sought a writ of habeas corpus under Act 1780 of 2001 and a pro se motion to amend the petition. The court denied the petition by order entered on December 31, 2008. Appellant filed a "request for modification/reversal" of the order on February 27, 2009, that was denied. Appellant lodged an appeal of the order denying the motion for reconsideration in this court.

Prior to the date that appellant's brief was due to be filed, he filed the instant motion that seeks an extension of time to file appellant's brief. Appellant asserts in the motion that circumstances concerning his incarceration have delayed his research and limited his access to materials. After filing the motion, appellant tendered his brief.

Appellant's motion to extend the time for filing is the first such request filed in this court. We grant the motion. Because appellant has tendered his brief, we direct our clerk to file the tendered brief as of the date of this opinion.

Motion granted.
