Order Per Curiam
This cause is currently before the Court because the reporter's record has not been filed. The reporter's record was originally due on February 17, 2017. The Court has been advised that the reporter who took the record has died and that another reporter, Roxanne Davenport, has been appointed to prepare the record for this appeal. Ms. Davenport is preparing the record, but needs additional time.
This case is before the Court on transfer from the Third Court of Appeals in Austin pursuant to a docket equalization order issued by the Supreme Court of Texas. See TEX. GOV'T CODE ANN. § 73.001 (West, Westlaw through 2015 R.S.).
The Court, having fully examined and considered the delay surrounding the preparation of the record, is of the opinion that, in the interest of justice, the reporter's request for additional time to file the record should be granted. We grant the reporter's request to file the record on or before August 1, 2017. If additional time is needed, the reporter is directed to file another extension request.
Under these circumstances and in order to effectuate the proper and complete presentation of this appeal to the Court, we ABATE this appeal and remove it from the Court's active docket. The appeal will be reinstated when the reporter's record has been filed.
