Rexford v. Frazier

Appellate Division of the Supreme Court of New York, Fourth Department
May 1, 1921
197 App. Div. 928 (N.Y. App. Div. 1921)

Opinion

May, 1921.

Judgment affirmed, with costs. Held, while we are of the opinion that a judgment for the delivery of an undivided one-half of some of the property in question cannot be sustained, yet in view of the fact that the property has been sold, as appears by statement made upon the argument, and the avails thereof are in the hands of the constable, for distribution, we think the judgment may properly be affirmed. All concur.
