ORDER

This case is calendared for trial on the Court's May 16, 2022, New York City, New York trial session. On April 19, 2022, petitioner filed an unopposed Motion for Continuance asking the Court to restore this case to the general docket. The motion states that on April 8, 2022, petitioner's counsel held a telephone conference with the Appeals officer regarding the possibility of pre-trial settlement, and that the parties have reached an agreement on most of the items in dispute; the remaining items were lacking substantiation. The Appeals officer agreed to allow petitioner extra time to obtain substantiation of the remaining disputed items in the hopes of reaching a settlement with petitioner's counsel. On April 18, 2022, petitioner's counsel received substantiation from petitioner to provide to the Appeals officer for review.

Upon due consideration, it is

ORDERED that petitioner's Motion for Continuance of trial is granted and this case is stricken from the Court's May 16, 2022, New York City, New York trial session and is continued generally. 1
