DECISION & ORDER ON MOTION

Motion by the appellant for leave to withdraw the brief previously filed and to file a replacement brief on an appeal from an order of the Supreme Court, Westchester County, dated October 26, 2010.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is granted, the appellant's brief is deemed withdrawn, and on or before October 5, 2011, the appellant shall serve and file the replacement brief; and it is further,

ORDERED that the respondent shall serve and file a brief in response to the appellant's replacement brief in accordance with the rules of the Court (see 22 NYCRR 670.8[b]).
