ORDER


The Court has considered Plaintiffs Second Motion to Compel Discovery Responses (Discovery Dispute No. 3), filed October 9, 2002, and Defendant's response. The motion is denied. The Court has also considered Defendant's Motion for Reconsideration of portions of the United States Magistrate Judge's August 9, 2002 order, filed October 11, 2002, and Plaintiffs response. The motion for reconsideration is denied. Additionally, the Court has considered Defendant's Motion for Rule to Show Cause Why Plaintiff Should Not be Held in Contempt, filed October 11, 2002 and Plaintiffs response. The Court finds no clear and convincing evidence of contempt. Accordingly, Defendant's motion seeking to have Plaintiff held in contempt is denied.
