Republic Bank of Savings v. Stein

Appellate Division of the Supreme Court of New York, Second Department
Oct 23, 1995
220 A.D.2d 654 (N.Y. App. Div. 1995)

Opinion

October 23, 1995

Appeal from the Supreme Court, Rockland County (Weiner, J.).

Ordered that the order and judgment is affirmed, with costs.

We agree with the Supreme Court's conclusion that the appellants failed to raise a triable issue of fact (see, Zuckerman v. City of New York, 49 N.Y.2d 557, 562). The Supreme Court therefore properly granted the plaintiff's motion for summary judgment (see, CPLR 3212 [b]). Bracken, J.P., Rosenblatt, Santucci and Joy, JJ., concur.
