Petitioner has filed multiple documents at index numbers 65-69. On August 9, 2024, respondent filed a Status Report (Index no. 70).
On August 12, 2024, petitioner electronically filed a Motion to Dismiss for Failure to Prosecute Properly (Index no. 71) along with a Declaration in Support (Index no. 72) and three documents labeled Exhibits (Index nos. 73-75).
On August 13, 2024, petitioner filed in paper a second Motion to Dismiss for Failure to Properly Prosecute (Index no. 76) that is a duplicate of the Motion electronically filed on August 12, 2024, except that attached to the second Motion is a copy of the envelope in which petitioner mailed his Motion.
Also on August 13, 2024, petitioner filed in paper a second Declaration in Support of his Motion (Index no. 77) that is duplicate of the Declaration electronically filed on August 12, 2024, except that Exhibits are attached to the second Declaration.
Upon due consideration, it is hereby
ORDERED that petitioner's Motion to Dismiss for Failure to Prosecute Properly (Index no. 71) filed on August 12, 2024, is stricken from the record in this case. It is further
ORDERED that petitioner's Declaration in Support of Motion to Dismiss for Failure to Properly Prosecute (Index no. 72) filed August 12, 2024, is stricken from the record in this case. It is further
ORDERED that petitioner's Motion to Dismiss for Failure to Prosecute Properly filed August 13, 2024, is held in abeyance pending respondent's review and reconsideration of the documentation recently provided to the Appeals Officer. It is further
ORDERED that, on or before September 20, 2024, the parties shall file with the Court a joint report (or, if that is not expedient, then separate reports) describing the status of the case.
