Opinion

Case Nos. 02-3458, 02-3455.

Opinion filed November 26, 2003.

An appeal under Fla. R. App. P. 9.141(b)(2) from the Circuit Court of Miami-Dade County, Daryl E. Trawick, Judge, Lower Tribunal Case No. 99-18692.

Bennett H. Brummer, Public Defender, and Roy A. Heimlich, Assistant Public Defender, for appellant.

Charles J. Crist, Jr., Attorney General, and Erin K. Zack, Assistant Attorney General, for appellee.

Before GERSTEN, FLETCHER, and SHEPHERD, JJ.

We affirm on the basis that the Federal Bureau of Prisons has determined that Joseph Edward Renne's federal sentence commenced on the order of imposition pursuant to a nunc pro tunc designation. Were such not the case we would be inclined to grant relief.

NOT FINAL UNTIL TIME EXPIRES TO FILE REHEARING MOTION AND, IF FILED, DISPOSED OF.
