DECISION & ORDER ON MOTION

Motion by the respondent Dutchess County Department of Social Services in a proceeding pursuant to CPLR article 78, which was transferred to this Court by an order of the Supreme Court, Dutchess County, dated June 17, 2011, to dismiss the petition insofar as asserted against it for failure to state a cause of action.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted and the petition insofar as asserted against the respondent Dutchess County Department of Social Services is dismissed, without costs or disbursements.
