Opinion
No. 04-13-00343-CV
06-27-2013
Rick REILEY and Gary K. Weddle, Appellants v. Pleas D. "Beau" ANDERSON II and Margaret Anderson Appellees
From the 25th Judicial District Court, Guadalupe County, Texas
Trial Court No. 13-0074-CV
Honorable W.C. Kirkendall, Judge Presiding
ORDER
Pending before this court is Appellants' Motion for Writ of Injunction to Preserve Appellate Court Jurisdiction. In the motion, appellants refer to a motion they filed in the trial court entitled Motion to Stay Enforcement of Final Order of Dismissal and to Establish Security on Appeal. A copy of the motion filed in the trial court is not attached to the motion filed in this court. It appears likely that the motion was filed in the trial court pursuant to Rule 24 of the Texas Rules of Appellate Procedure, requesting the trial court to establish or determine the security appellants will be required to post in order to supersede the trial court's order pending appeal. Appellants' motion states that a hearing was held on the motion filed in the trial court; however, no reporter's record from that hearing accompanied the motion filed in this court. Appellants' motion is DENIED without prejudice to appellants seeking appellate review of a motion filed in the trial court pursuant to Rule 24; however, any subsequent motion filed in this court seeking appellate review should be accompanied by a copy of the motion filed in the trial court and a complete record of any hearing on that motion.
