On Appeal from the Collin County Probate Collin County, Texas Trial Court Cause No. PB1-1777-2020
ORDER
BILL PEDERSEN, III JUSTICE
As previous orders reflect, having the reporter's record in this appeal filed in its entirety has been no easy task. The issue stems from the proceedings being both stenographically and electronically recorded as well as more than one reporter being involved. Thus far, the reporter's record of the trial, which was stenographically recorded by court reporter Carolyn England, has been filed. Additionally, the recordings of the electronically recorded proceedings have been provided to appellant for transcription. However, the transcript, due to be filed at or before the filing of appellant's brief, has not yet been filed although appellant's brief has been filed. Also not yet filed is the reporter's record of a proceeding held September 13, 2021, and stenographically recorded by court reporter Sharon Pearson. The record of that proceeding is due January 6, 2025, and any amended brief appellant wishes to file is due no later than January 21, 2025.
Confused about when her brief is due and when the transcript of the electronically recorded proceedings is to be filed, appellee has filed a motion to (1) abate the appeal until the record is complete and (2) clarify the deadline for the filing of her brief. We GRANT the motion TO THE EXTENT we ORDER the transcript of the electronically recorded proceedings filed no later than January 6, 2025, the same date the record of the September 2021 proceeding is due. We further ORDER appellant to file any amended brief within fourteen (14) days, and appellee to file her brief within forty-five (45) days, of the later filing of the outstanding record or transcript.
