No. 05-07-00888-CV (Tex. App. Jun. 18, 2008)

Opinion

No. 05-07-00888-CV

Opinion issued June 18, 2008.

On Appeal from the 101st Judicial District Court, Dallas County, Texas, Trial Court Cause No. 07-00077-E.

Before Justices MORRIS, WHITTINGTON, and O'NEILL.

MEMORANDUM OPINION

This Court received Michael Reeves's original appellate brief on August 24, 2007. On November 27, 2007, we informed appellant that his original brief was deficient because it did not comply with Texas Rule of Appellate Procedure 38.1, subsections (a), (b), (c), (d), (e), (f), (g), (h), (i), and (j). Appellant was instructed to correct the deficiencies and file an amended brief within ten days of the November 27 letter.

The Court filed appellant's amended appellate brief on January 14, 2008. Appellant's amended brief failed to comply with rule 38.1. Therefore, on the Court's own motion, we struck appellant's January 14, 2008 amended brief. See Tex. R. App. P. 38.9(a). We now DISMISS this appeal for want of prosecution. See Tex. R. App. P. 38.8(a), 38.9(a), 42.3(b).
