In a 2-1 decision, the court of appeals reversed, concluding that the City's decision was based on an erroneous interpretation of the law and that Reetz was acting in the performance of his duties as a police officer during his shift at the shelter on the day of the stabbing. Reetz v. City of St. Paul , No. A19-1425, 2020 WL 2703843, at *6 (Minn. App. May 26, 2020). The court of appeals concluded that Reetz was acting in a dual capacity as a police officer and a private security guard.
