This case was called and recalled from the calendar for the Trial Session of the Court at Las Vegas, Nevada on April 22, 2024. Prior to the trial session, on April 1, 2024, respondent filed a Motion to Dismiss for Lack of Prosecution. By Order served on the parties on April 2, 2024, the Court ordered petitioner to show cause in writing, on or before April 12, 2024, why this case should not be dismissed for lack of prosecution. When the case was called and recalled from the calendar, petitioner and counsel for respondent appeared and were heard. At the recall, the parties represented to the Court that they had reached a basis for settlement that resolves all issues in the case, and counsel for respondent stated the terms of the settlement for the record. On April 23, 2024, the parties filed a Stipulation of Settled Issues that memorializes the terms of the settlement. Upon due consideration and for cause more fully appearing in the transcript of the proceeding, it is hereby
ORDERED that respondent's Motion to Dismiss for Lack of Prosecution, filed April 1, 2024, is denied as moot. It is further
ORDERED that the Court's Order to Show Cause, served on the parties on April 2, 2024, is discharged. It is further
ORDERED that jurisdiction of this case is retained by this Division of the Court. It is further
ORDERED that the parties shall, on or before June 24, 2024, submit to the Court an agreed stipulated decision document or file status reports, separately or jointly, apprising the Court of the then present status of this case.
