ORDER TO VACATE JUDGMENT


AND NOW, this 23rd day of December, 2004, upon consideration of REESE'S UNOPPOSED RULE 60 MOTION TO VACATE AND REVISE THE COURT'S FINAL JUDGMENT TO INCORPORATE THE AMOUNT OF REFUND DUE (Document No. 31), the Court finds the Motion well taken.

NOW THEREFORE, it is ORDERED, ADJUDGED and DECREED that Reese's Motion is GRANTED and the Court's November 30, 2004 Final Judgment is VACATED. A revised Final Judgment will be issued when the amount of refund due is ascertained. It is further ORDERED that the Parties shall report to the Court regarding their progress on determining the amount of refund due Reese on or before January 28, 2005.
