Reef Investments v. Valle

District Court of Appeal of Florida, Fourth District
Dec 8, 1999
745 So. 2d 544 (Fla. Dist. Ct. App. 1999)

Opinion

No. 98-4369.

Opinion filed December 8, 1999.

Appeal from the Circuit Court for the Seventeenth Judicial Circuit, Broward County; Estella May Moriarty, Judge; L.T. No. 97-1721 CA 05.

Leonard P. Fenn of DeFabio and Fenn, P.A., Coral Gables, for appellant.

Linda A. Conahan and Ann M. Burke of English, McCaughan O'Bryan, P.A., Fort Lauderdale, for appellees.

We affirm the Final Judgment Denying Foreclosure. The trial court correctly applied the doctrine of laches in favor of appellees. See Travis Co. v. Mayes, 36 So.2d 264 (Fla. 1948); Ratner v. Miami Beach First Nat'l Bank, 368 So.2d 1326, 1328 (Fla. 3d DCA 1979); Briggs v. Estate of Geelhoed ex rel. Johnson, 543 So.2d 332, 333(Fla. 4th DCA 1989).

AFFIRMED.

WARNER, C.J., DELL and GUNTHER, JJ., concur.
