JUDGMENT


The Court has entered its Findings in the case, accepting the Findings and Recommendation of the United States Magistrate Judge. Therefore,

It is ORDERED, ADJUDGED and DECREED that the District Clerk's Entry of Default Against Donnie Scott and the District Clerk's Entry of Default Against Patricia Scott, each filed May 21, 2004, are hereby VACATED. IT IS FURTHER ORDERED, ADJUDGED and DECREED that Plaintiff's federal claims in this matter are DISMISSED WITH PREJUDICE pursuant to 28 U.S.C. § 1915(e)(2) and Plaintiff's state claims are DISMISSED WITHOUT PREJUDICE.

It is further ORDERED that the Clerk shall transmit to the parties a true copy of this Judgment, together with a true copy of the Order Accepting the Findings and Recommendation of the United States Magistrate Judge.
