MEMORANDUM OPINION


The Court's records in this appeal reveal that appellant has not filed an amended brief in compliance with the rules of appellate procedure. See Tex.R.App.P. 38.1. Appellant was informed in a September 21, 2004 letter that failure to file an amended brief within ten days would result in dismissal of this appeal. Appellant has not filed an amended brief in compliance with the rules of appellate procedure.

On the Court's own motion, this appeal is DISMISSED for want of prosecution. See Tex.R.App.P. 42.3(b), (c).
