Reddie v. Metropolitan Dade Cty

District Court of Appeal of Florida, Third District
Apr 4, 2001
826 So. 2d 1019 (Fla. Dist. Ct. App. 2001)

Opinion

No. 3D99-2372.

Opinion filed April 4, 2001.

An Appeal from the Circuit Court for Miami-Dade County, Eleanor Schockett, Judge. Lower Tribunal No. 96-13208.

Affirmed.

Maria E. Consuegra, Miami, for appellants.

Robert A. Ginsburg, County Attorney, and Ronald J. Bernstein, Assistant County Attorney, for appellees.

Before Fletcher, Shevin, and Ramirez, JJ.

We affirm the summary judgment entered in favor of Metropolitan Dade County because the plaintiffs/appellants failed to comply with the notice requirements of section 768.28(6)(a), Florida Statutes (1993), by having filed its notice only with the City of Miami.
