This case was recently assigned to the undersigned solely for the disposition of the Commissioner's motion to dismiss for failure to properly prosecute filed on February 28, 2024. We will direct petitioner Craig E. Reckley to file a response to the motion and appear for a hearing on the motion at the Court's Tampa, Florida trial session, scheduled to begin May 6, 2024. Accordingly, it is

ORDERED that, on or before April 15, 2024, Mr. Reckley shall file a response to the motion to dismiss for failure to properly prosecute. It is further

ORDERED that this case is calendared for hearing on the Commissioner's motion to dismiss for failure to properly prosecute, at the Court's Tampa, Florida trial session, commencing May 6, 2024, at 10:00 a.m., in Room 1201, 12th Floor, at the Timberlake Federal Annex, 501 East Polk Street, Tampa, Florida 33602. Failure to file a response to the Commissioner's motion or failure to appear at the hearing may result in the dismissal of this case and entry of decision against Mr. Reckley.

This Order constitutes official notice to the parties.
