Opinion filed May 22, 1940 Rehearing denied June 14, 1940

TRADE MARKS AND TRADE NAMES, § 14infringement. Defendant was properly enjoined from trade mark and trade name infringement, where plaintiff distributed frankfurters under name "Real" frankfurters, and there was some confusion with defendant's use of the name "Reo," and defendant admitted use of deceptive containers by contending that it had abandoned such use before trial by agreement with plaintiff.

Appeal from Circuit Court of Cook county; Hon. STANLEY H. KLARKOWSKI, presiding.

Affirmed. Heard in third division, first district, this court at October term, 1939.
