The claims in this action are premised upon the parties' relationship pursuant to the License Agreement, not a contract for a sale of goods. As such, the applicable statute of limitations is the six-year statute of limitations pursuant to N.J. Stat. Ann. ยง 2A:14-1. See R.C. Beeson, Inc. v. Coca Cola Co., No. 074806, 2008 WL 4447106, at *5 (D.N.J. Sept. 26, 2008). Because Plaintiff's breach of contract claims extend back to 2014, and because the claims in the instant action are analogous to the claims in Plaintiff's 2020 complaint
To hold otherwise would undermine the purpose of the statute of limitations by permitting a plaintiff to sit on his rights unless and until he determines to pursue them, and would keep defendants on the hook in perpetuity. See R.C. Beeson, Inc. v. Coca Cola Co., No. 07-4806, 2008 WL 4447106, at *5 (D.N.J. Sept. 26, 2008) ("Generally, the purpose of a statute of limitations is to weed out stale claims where the reliability of the evidence becomes suspect. According to the Supreme Court, such statutes are: designed to promote justice by preventing surprises through the revival of claims that have been allowed to slumber until evidence has been lost, memories have faded, and witnesses have disappeared.
