Summary
In Raymond v. Tiffany (140 App. Div. 909) this court affirmed a judgment dismissing the complaint in a suit in equity brought under the statute to which reference has been made, to reach a surplus of income of a trust fund upon the ground that by the particular terms of the trust then before the court the beneficiary had no absolute right to receive any income, and, therefore, the plaintiff could not sustain the burden of showing that the judgment debtor was entitled to receive more income than sufficient for his support.
