Carlos Antonio RAYMOND, Appellant v. Martin Joseph ROY and Pizza Venture of San Antonio, LLC d/b/a Papa John's Pizza, Appellee

From the County Court At Law No. 10, Bexar County, Texas
Trial Court No. 2015CV00935
Honorable David J. Rodriguez, Judge Presiding

ORDER

On June 28, 2017, we struck Appellant's brief for multiple failures to comply with the requirements for an appellate brief. See TEX. R. APP. P. 38.1. We ordered Appellant to file a brief that fully complied with the applicable rules not later than August 21, 2017.

Appellant timely filed an amended brief, but contrary to our order, the brief does not meet all of the applicable rules for an appellate brief. Contra id. Nevertheless, at least one issue may be sufficiently briefed to avoid waiver of appellate review. See id.; Perry v. Cohen, 272 S.W.3d 585, 587 (Tex. 2008) (construing briefs). Appellant's motion for leave to file an amended brief is moot.

Although some issues may be waived for failure to adequately brief them, our June 28, 2017 order is sufficiently satisfied to avoid waiver of all appellate issues.

Appellee's brief is due within THIRTY DAYS of the date of this order.

Patricia O. Alvarez, Justice

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 21st day of August, 2017.
