Carlos Antonio RAYMOND, Appellant v. Martin Joseph ROY and Pizza Ventrue of San Antonio, LLC d/b/a Papa Johns Pizza, Appellees

From the County Court At Law No. 10, Bexar County, Texas
Trial Court No. 2015CV00935
Honorable David J. Rodriguez, Judge Presiding

ORDER

On February 27, 2017, Appellant Carlos Antonio Raymond, acting pro se, moved this court to proceed with his appeal without paying this court's costs. See TEX. R. APP. P. 20.1(a) (defining costs for an appellate court); id. R. 20.1(c) (providing guidance when no Statement was filed in the trial court).

On March 8, 2017, we granted Appellant's request for a free copy of the clerk's record.

On March 9, 2017, because Appellant did not file a Statement of Inability to Afford Payment of Court Costs in the trial court, and he had not filed one in this court, we ordered Appellant to file a Statement. See TEX. R. CIV. P. 145(b).

In our March 9, 2017 order, we advised court reporter Kay Counsellor that she could "move to require the declarant to prove the inability to afford costs." See TEX. R. CIV. P. 145(f)(3). If she chose to do so, we ordered her to file the motion within ten days of when Appellant filed his Statement.

On March 21, 2017, Appellant filed a Statement, and the court reporter's motion was due on March 31, 2017. The court reporter did not timely filed a motion.

Appellant's motion to proceed with this appeal without paying this court's costs, see TEX. R. APP. P. 20.1, and his motion for a free reporter's record, see TEX. R. CIV. P. 145, are GRANTED.

We DIRECT the clerk of this court to prepare and make available to Appellant a free, electronic copy of the reporter's record at no cost to Appellant. See TEX. R. APP. P. 20.1.

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 5th day of April, 2017.
