Carlos Antonio RAYMOND, Appellant v. Martin Joseph ROY and Pizza Ventrue of San Antonio, LLC d/b/a Papa Johns Pizza, Appellee

From the County Court At Law No. 10, Bexar County, Texas
Trial Court No. 2015CV00935
Honorable David J. Rodriguez, Judge Presiding

ORDER

On February 3, 2017, Appellant Carlos Antonio Raymond filed a combined motion for new trial and notice of appeal in this court for trial court cause number 2015-CV-00935. On February 16, 2017, Appellant filed an amended notice of appeal that did not include a motion for new trial. As of February 16, 2017, the jury had returned a verdict, but the trial court had not signed a final judgment.

On March 24, 2017, the trial court signed a final judgment.

We construe Appellant's February 16, 2017 notice of appeal as a prematurely filed notice of appeal. See TEX. R. APP. P. 27.1(a). Its effective date is the date the trial court's judgment was signed: March 24, 2017. See id.

We reinstate the appellate timetable. The clerk's record has already been filed. The reporter's record is due on May 23, 2017. See id. R. 35.1.

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 4th day of April, 2017.
