This case was calendared for trial at the (virtual) Session of the Court commencing on September 13, 2021, in Boston, Massachusetts. Prior to the trial session, on August 23, 2021, respondent filed a Motion to Dismiss for Lack of Prosecution. By Order served on the parties on August 26, 2021, the Court ordered petitioner to (1) contact the chambers of the undersigned as soon as possible for the purpose of scheduling a conference call to discuss respondent's motion and the status of this case and (2) show cause in writing, on or before September 7, 2021, why this case should not be dismissed for lack of prosecution. Petitioner responded to the Court's order to contact the undersigned's chambers but did not respond to respondent's motion. In contacting the undersigned's chambers, she informed the undersigned that she had not spoken to respondent; the undersigned suggested that she contact respondent to discuss her case. On September 2, 2021, respondent contacted the undersigned's chambers to inform the Court that the parties would be settling the case and that a proposed stipulated decision would be filed on or before the September 13, 2021, Boston, Massachusetts Trial Session. On September 13, 2021, the parties filed a Proposed Stipulated Decision resolving this case. Upon due consideration and for cause, it is hereby
ORDERED that the Court's Order to Show Cause, served on the parties on August 26, 2021, is discharged. It is further
ORDERED that respondent's Motion to Dismiss for Lack of Prosecution, filed August 23, 2021, is denied as moot.
