ORDER


Petitioner Lynn Rayl has requested an enlargement of time in which to pay the initial partial payment of the filing fee in this case. He notes that he does not have a release account and that he does not presently have $22.48 in his regular inmate account. Therefore, IT IS ORDERED that petitioner's request for an enlargement of time to pay the initial partial payment assessed to him on November 24, 2004 is GRANTED.

Petitioner may have until January 14, 2005, in which to submit a check or money order made payable to the clerk of court in the amount of $22.48. If, by January 14, 2005, petitioner fails to pay the initial partial payment or show cause for his failure to do so, he will be held to have withdrawn this action voluntarily. In that event, the clerk of court is directed to close this file without prejudice to petitioner's filing his case at a later date.
