Ray v. Weisman

District Court of Appeal of Florida, Fourth District
Oct 29, 1976
338 So. 2d 66 (Fla. Dist. Ct. App. 1976)

Opinion

No. 75-1680.

September 24, 1976. Rehearing Denied October 29, 1976.

Appeal from Circuit Court, Orange County; Richard B. Keating, Judge.

Seymour Benson of Jacob Benson, Orlando, for appellant.

Michael R. Walsh, Orlando, for appellee Marvin Weisman.

This appeal is dismissed for lack of jurisdiction because the appellant failed timely to appeal from an order of July 30, 1975, which dismissed his complaint with prejudice and which, therefore, constituted an appealable final judgment against him.

DISMISSED.

DOWNEY, J., SCHWARTZ, ALAN R., and MORROW, RUSSELL O., Associate Judges, concur.
