Rauscher v. Rauscher

Appellate Division of the Supreme Court of New York, Second Department
May 1, 1933
239 App. Div. 837 (N.Y. App. Div. 1933)

Opinion

May, 1933.

Present — Lazansky P.J., Young, Kapper, Scudder and Tompkins, JJ.

Judgment unanimously affirmed, with costs. The evidence is sufficient to sustain the judgment on the ground of abandonment and lack of support. It appears that the defendant paid the alimony of twenty dollars a week granted pendente lite, which was continued by the final judgment. This, together with the other evidence on the subject, is sufficient to uphold the award of alimony.
