ORDER
Ronald L. Buch, Judge
This case is calendared for trial at Court's February 14, 2022, San Francisco, California trial session. On January 14, 2022, the Commissioner filed a Motion for Continuance asking the Court to continue this case and restore the case to the general docket. On January 20, 2022, the Court ordered Ms. Rasmussen to respond to the Commissioner's Motion for Continuance by January 28, 2022. In light of the recent increase in COVID-19 cases driven by the circulation of the highly contagious Omicron variant, the Court has determined that it is no longer advisable for the case to go forward in person at the February 14 session.
It remains unknown whether Ms. Rasmussen objects to a general continuance of her case. If Ms. Rasmussen objects to the Commissioner's motion, the Court will work with the parties to schedule this case for future trial. If Ms. Rasmussen does not object or fails to respond to the Commissioner's motion, the Court will restore this case to the general docket for scheduling at a later time. While we await Ms. Rasmussen's response, it is
ORDERED that the Commissioner's motion is granted in that this case is continued and stricken from the above-referenced trial session, and the parties are excused from appearing at the calendar call on February 14, 2022. It is further
ORDERED that jurisdiction of this case is retained by the undersigned.
